Thank you for downloading ABENA.ai (“ABENA”) or ABENA.ai Pro (“ABENA Pro”). ABENA and ABENA Pro were developed by, and are owned and operated by, Mobobi .

It is the policy of Mobobi to respect your privacy, and the privacy of all users of our applications. This Privacy Policy (the “Policy”) has been established to help you understand our commitment to protecting your privacy, and the steps we take to ensure it. This Policy was last modified on November 6, 2022. Mobobi reserves the right, at any time and without prior notice, to modify the Policy.

Your privacy is very important to us and we want you to know everything we do and don’t do with the information you provide. Our guiding principle is that any information we collect from you will be treated with the utmost care and respect, and every effort will be made to ensure the information is kept private.

For purposes of the Policy, “Application” refers to ABENA or ABENA Pro, as the case may be. Application also includes any Application updates and upgrades that Mobobi may provide to you or make available to you, or that you obtain after the date you obtain your initial copy of the Application, to the extent that such items are not accompanied by a separate Privacy Policy.

1. WHAT INFORMATION DO WE COLLECT?

ABENA.ai works offline and does not gather any of your personal information while you are interacting with the voice assistant AI

ABENA performs the recording and transcribing of audio offline, without internet connectivity. Your privacy is protected as speech data stays on the device. Even though recording and transcribing of audio is performed on-device (offline), your audio streams may be sent to our server to improve and help make ABENA work better for you. This feature can be turned off in the “Settings” of the application. You can also view and delete all audio streams saved on your device, if any.

Any outgoing data (which may be sent via ABENA to the server) consists of:

-The audio stream

-The instance ID

We may collect information regarding your: Device ID, Advertising ID, your primary Google account name, email address and profile picture(If you choose to link your third party Google account with us).

We may also collect your social friends list, social posts(texts, comments, images, urls) you share when you use ABENA.ai or ABENA.ai Pro.

Users can choose whether this data is collected.


2. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via ABENA.ai for a variety of App functionality and business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

- To facilitate account creation and login process. If you choose to link your account with us to a third party Google account, we use the information you allowed us to collect from the third party(Google) to facilitate account creation and logon process for the performance of the contract. See the section below headed "HOW DO WE HANDLE YOUR SOCIAL LOGINS" for further information.

- Deliver targeted advertising to you. We may use your information to develop and display content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.

General Information Transfer Any information or data the Application collects may be stored locally on your device. Additionally, you may share data between the Device and other devices via Bluetooth. You may also share data using the Application’s Share function.


3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In Short: We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.

We may process or share data based on the following legal basis:

- Third-Party Advertisers: We may use third-party advertising companies to serve ads when you visit the Apps. These companies may use information about your visits to our Website(s) and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you.

- Other Users: When you share personal information (for example, by posting comments, contributions or other content to the Apps) or otherwise interact with public areas of the Apps, such personal information may be viewed by all users and may be publicly distributed outside the Apps in perpetuity. If you interact with other users of our Apps and register through a social network (such as Facebook), your contacts on the social network will see your name, profile photo, and descriptions of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our Apps, and view your profile.

- Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

- Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.


4. ABOUT THIRD-PARTY ADVERTISEMENTS

Where you have downloaded ABENA, the Application uses Google, a third party vendor, to serve advertisements in the Application, using the AdMob system (see http://www.google.com/ads/admob/). By using the Application, you consent to the delivery of these advertisements and any data collected by Google, as per the Privacy Policy of AdMob (found at http://www.admob.com/home/privacy).


5. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in to our services using a social media account, we may have access to certain information about you.

ABENA offers you the ability to register and login using your third party Google account. Where you choose to do this, we will receive certain profile information about you from Google. The profile Information will often include your name, e-mail address, friends list, profile picture as well as other information you choose to make public. We will use the information we receive only for the purposes that are described in this privacy notice or that are otherwise made clear to you on the Apps. Please note that we do not control, and are not responsible for, other uses of your personal information by your third party account provider. We recommend that you review their privacy policy to understand how they collect, use and share your personal information, and how you can set your privacy preferences on their sites and apps.


6. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than the period of time in which users have an account with us. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.


7. USER CONTROL AND UNINSTALL

You can access and change user settings from the options/settings menu on your device. Uninstall methods vary depending on your device. Mobobi has no control over these functions and denies any responsibility of your use thereof, and any data or personal information sent to third parties as a result of said activities.


8. PERMISSIONS

The following is a complete listing and description of what functions on the Device are accessed and / or modified by the Application. Unless otherwise indicated, the permission applies to both ABENA and ABENA Pro:

FULL NETWORK ACCESS

Allows the Application to create network sockets and use custom network protocols.

MODIFY OR DELETE THE CONTENTS OF YOUR USB STORAGE / MODIFY OR DELETE THE CONTENTS OF YOUR SD CARD

Allows the Application to perform speech recognition. Allows the App to write speech data to the USB storage and / or SD card.

RECORD AUDIO

Allows the Application to make Recordings(Voice Notes, Sermons etc) using the microphone.

CALL PHONE

Allows the Application to make phone calls

ACCESSIBILITY SERVICE

ABENA.ai uses the accessibility service for screen reading (only if the permission is granted). Accessibility Service api is used by Abena AI for screen reading to enable blind or visually impaired Ghanaians check their call credit & data plans. Abena does this by e.g dialing USSD short code *124# and reading out loud the call credit/data text upon a voice command. This is very useful, especially for users with visual or hearing impairment as it simplifies the complex process of reading out short code outputs.
How does this work? Once a voice command is spoken, E.g "Abena, Do I have enough data?(In Twi)", Abena dials the corresponding USSD short code *124#, translates and reads out loud the USSD short code response. E.g "Mary, you have 5mb of data and 2gh credit remaining (In Twi)". The entire process is done offline, without the internet - Speech recognition, translation and text to speech are all done offline. Data is not collected nor shared. Accessibility Service is only used when Abena AI is opened and receives a voice command.

9. SOCIAL POSTS AND COMMENTS RULES


By sharing your posts, posting statuses and commenting within the app, you agree to these rules. You will be banned from using the social feature if you violate these rules


10. RISKS ASSOCIATED WITH THE INTERNET OR WIRELESS DATA TRANSMISSION


Despite Mobobi’s efforts to ensure third parties will not access or obtain your personal information through the Application, complete confidentiality and security cannot currently be guaranteed on the Internet and / or where data is transferred via wireless digital technology of any type. Communication in this manner is subject to interception, loss, or alteration. You acknowledge and agree that Mobobi cannot be held responsible for damages resulting from the transmission of information in this manner and that such communications are at your own risk.

11. LIMITATION OF LIABILITY

Mobobi, and / or its respective officers, directors, owners, officials, partners, partnerships, principals, employees, affiliates and other related entities, servants, agents, representatives, successors and assigns, will not be held liable for any damages resulting from the misuse of any information collected through the Application by any third party, or any misuse of any information collected through the Application not in violation of the Policy.
